“Italy”

The Court of Cassation has recently expressed itself over the lawfulness of the wording “Italy” or of a tag representing the Italian flag bearing the wording “Italy” for clothing articles of an Italian company manufacturing in China and which imports its products in Italy. The Court, with decision no. 13712 of April 14th, decided that the determining factor of the issue is not the geographical origin of the product but its manufacturing technique, which, when respected, confers rights to bear such wording, even if the products were actually manufactured in China.
