Highly Reputed Marks

For the first time, the BPTO has recognized trademarks as highly reputed marks, as stated in art.125 of Law no. 9.279/96 (Brazilian Industrial Property Law). According to this article, the registered trademark considered highly reputed in Brazil, is protected in all fields of activity. Infringement of a trademark recognized as if high repute is punishable by higher criminal penalties, according to Brazilian IP Law section 125. Such trademarks are: “HOLLYWOOD” for clothing articles and tobacco, “MCDONALD’S & DESIGN” and “PIRELLI & DESIGN” for electric and insulating materials.
