Romania, Supplementary Protection Certificates
On December 21st, 2004, the Romanian Parliament has passed a new law regarding Supplementary Protection Certificates for drugs and products of phyto-sanitary use which are protected by patents. The law will come into force starting on January 1st, 2007, when Romania joins the EU. Application for Certificates must be filed with OSIM (State Office for Inventions and Trademarks) within six months from the date on which the product has obtained the Authorization or from the date of granting of the patent (if the Authorization was issued before grant of the patent).
