India, Inventor’s Declaration

The Controller General has implemented changes in the filing requirements about inventor declaration for submitting conventional and PCT National Phase Applications in India. If the application has been filed by a person other than the true and first inventor, and is filed in India by the person who is not the applicant in the Convention country, then proof of right shall be required for filing. If the applicant in the Convention country and India is the same person, then the applicant is only required to file the Declaration of inventorship along with a declaration that the applicant in the convention country is the assignee of the true and first inventor. The above applies to applications filed through PCT, applications under National Phase and Conventional applications
