Morocco, New Ip Law No. 17-97

As of December 18th, 2004, with new Law 17-97 two types of compulsory licenses are provided.: a general compulsory license and a ex officio license. The general compulsory license can be granted to any interested party after 3 years from the date of grant, or 4 years from the date of filing in the cases of non-use, insufficient commercialization, working or marketing abandonment of the patent for more than three years. Ex-officio compulsory licensing can be requested for national defence, public health interest and/or national economic reasons.
