Spain’s Appeal Against Unitary Patent Package

The General Attorney of the Court of Justice of the European Union (CJEU) has issued some opinions in the two appeals (cases C-416/13 and C-417/13) against the unitary patent package. The appeals had been brought by Spain against EU regulation 1257/2012, and against EU regulation 1260/2012. The Advocate General advised the CJEU to reject both appeals. At the moment, Spain and Italy are the only two EU countries that declined to join the enhanced cooperation aimed at establishing the unitary patent.
