Art. 28

On August 2, 2004, the Intellectual Property Office announced a new interpretation of Art. 28 of the Patent Law. As of that date, no permission will be granted for any applicant’s request for an extension of time when the priority document cannot be submitted within 4 months from filing of the application. Formerly, the priority document was to be filed within three months from filing of the application, with the option of an extension up to 6 months. The change applies to all patent application filed in Taiwan after July 1, 2004.
