International priority is based on reciprocal recognition, meaning that only applicants from countries having a treaty or agreement with Taiwan for mutual recognition of priority rights were entitled to claim such rights. Since joining the WTO in January 2002, Taiwan recognizes priority right claims from citizens of all WTO member states. The grace period for claiming priority is one year for an invention patent and 6 months for a design patent. Taiwan is not a PCT Contracting State, therefore the 30 month grace period does not apply.
